Building an Effective Court Case

There isn't a legal time frame for cohabitation. It's worked out on the evidence of each case and the judge decides whether the relationship is cohabitation. The longer the time frame the more evidence there is for the Judge to consider.

The Judge will consider things such as:

  1. Birth of a child
  2. The sexual relationship between the parties
  3. Whether they live under the same roof
  4. Whether any or both have other accommodation
  5. The extent to which they do things as a couple
  6. The extent to which their finances are linked

None of these by themselves are conclusive. At the end of the day it will come down to what the Judge believes. So, the more evidence you have the better.

Make Sure With A Vehicle Tracker

If you’re not sure that your ex-partner is cohabiting Derby Detectives recommend the deployment of a 1 week vehicle tracker to the subjects’ vehicle, starting on a Monday through to Sunday.

This will give us the subjects daily routine both at the weekend and during the week. It will also confirm that they are staying at the property overnight. Once we have analysed the data from the tracker, we can use this information to put a plan in place for surveillance, with start and finish times.
